The Effect of Litigation on Claims of Personal Injury: A Statistical Study of 249 Cases

Litigation regarding personal injury takes up a large amount of court time and space. Persons with litigation are often different in several ways from those who do not have litigation. In this study 88.7% of these plaintiffs had nongenuine abnormalities characteristic of malingering on neurological examination compared to 5.4% of controls, and their symptoms and abnormalities were often unexplainably persistent. It appears that our legal system usually rewards persons with false and exaggerated claims. This results in higher insurance premiums and taxes for the citizens of this country while making attorneys that represent these persons with false claims wealthy. This encourages additional claims.
